Welcome to DeafPin.com web site ("Web Site"). This legal document serves as the Terms and Conditions ("T&C") that govern your use of the Web Site. These T&C describe your rights and responsibilities as visitors or members of the Web Site, and what you can expect from Deaf Pin ("Deaf Pin"). Please take a few minutes of your time to review the T&C. Your use of the Web Site constitutes your agreement to abide and be bound by the T&C. If you do not agree with any of the T&C, please do not use the Web Site.
Deaf Pin reserves the right to change the T&C at any given time without prior notifications. This includes (but not exclusively) our right to add to, delete or change these T&C from time to time. By continuing your use of the Web Site, you agree to be bound by the changes. We're not obliged to notify you of any changes and it is your responsibility to check the date of our updates on the T&C, located at the top of our T&C page. You're responsible to check our T&C from time to time to acquaint yourself with the most current version of our T&C.
Legal age of consent
Minors under the age of 13 are not allowed on our Web Site. Upon entering and using our Web Site, you acknowledge that you're at least 13 years of age or above.
Restricted Materials
Explicit materials are strictly forbidden on the Web Site. Any form of pornography, gore, bestiality, or suggestions toward ideologies to hatred and/or racism, illegal ideologies, attempts to upload pictures or videos that depict socially and morally illegal or unacceptable behaviours in positive lights, are not to be tolerated. An IP ban would take place for those who do not abide by the rules. Deaf Pin reserves the right to pass the tracking information on any of our visitors or members to the police, upon encountering one or more serious breaches of our T&C, such as involvements in child pornography, or involvements in other explicit materials.
Defamation
Involvements that harm Deaf Pin's reputation, Web Site, or our business and it's directors, representatives, employees, agents, affiliates, and our managers are strictly forbidden on the Web Site and/or on the general internet. Any of such involvements participated by you, will and may be taken to the court of law under the breach of our defamation policy. By using the Web Site you agree to be bound by these T&C.
Indemnification
You agree to indemnify and hold Deaf Pin and it's employees, directors, agents, affiliates and managers harmless from any damages, losses or expenses (including without limitation, reasonable legal costs and expenses on a full indemnity basis) incurred by you and our other visitors and members of the Web Site, arising from any claim, demand, action, suit or proceeding by any person against you where such a loss or liability arises out of, in respect of your use of the Web Site, any breach by you of these T&C and/or any goods/services you've purchased or interacted by you from our affiliates/advertisers and from the use of the Web Site.
Copyright & Trademark Information
We do not allow our members to cyber squat by registering on usernames belonging to trademarked names or belonging to corporations, (i.e. CocaCola, Starbucks, AppleInc, etc...) We reserved the right to disable any accounts that happened to register any trademarked names without signing up via the company's email addresses.
Members are not allowed to upload copyrighted and/or trademarked materials onto the Web Site without linking to the original content's website(s). By using our Web Site to "Pin" pictures make sure the website(s) in which you're "Pinning" the information from did not steal or infringe on any copyrighted media or materials.
Deaf Pin serves only as a social media vessel, to provide our visitors and members an avenue to view, and purchase any creative artwork and products from the original creator of the pictures, illustrations, videos, or other forms of media on our site. Deaf Pin is not liable for, and do not have any intentions to infringe, or steal any of the copyrighted materials onto our Web Site; but rather, by the policy of fair use, acts as a transformative website to bring more attention and publicity, sales, and/or traffic to the original artworker(s)' website(s) and businesses through the use of our Web Site. Creative Artists, and owners of the copyrighted materials on the Web Site, are encouraged to notify us if you believe that the Web Site is not providing an avenue towards more sales and traffic for your businesses and/or websites, but rather harming, reducing or restricting it. Deaf Pin reserves the right to comply towards the taking down of any media on the Web Site upon any original artwork creator's or exclusive copyright materials owner's requests within a reasonable time frame.
Limitation of Liability
In no event shall Deaf Pin or any of it's directors, manager, or affiliates be liable for any indirect, incidental, special, or consequential damages including but not limited to the loss of data, use, loss of business or profits. Deaf Pin is not liable for:
1: Any damages or injuries caused by the use or misuse of our Web Site, including any links to our advertisers or affiliates, and/or external links other than Deaf Pin originated from the original pinned website(s).
2: Any errors, inaccuracies or mistakes on the Web Site.
3: You acting, or failing to act, on any information contained on, or referred to on our Web Site, and/or including any externally linked websites.
4: Any unauthorised access to or use of our secure servers and/or any personal information stored on those servers.
5: Any interruption or cessation of transmission to or from our Web Site, and/or any viruses, trojan horses, bugs, or other harmful codes or communications which may be transmitted to or through the Web Site via any third parties.
6: Any damages/interruptions/cessation on the Web Site due to Acts of God, failed functionings of the servers, failed financial and/or management inabilities for our company and it's directors and managers to manage the Web Site due to any reasons stated or not stated on the T&C.
Jurisdiction
These T&C are legally binding upon each visitors/members of Deaf Pin and it's managers and directors, and governed by and construed in accordance with the laws of the State of Arizona. These T&C are governed by the internal substantive laws of the State of Arizona, USA, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these T&C, which shall remain in full force and effect. No waiver of any of these T&C shall be deemed a further or continuing waiver of such term or condition or of any other terms or conditions.
